www.PremierSpecialtyServices.comPremier Specialty Services warrants that its product, ULTIMATE Fine Fabric Protector, when properly applied to fabric or carpet, will provide the maximum stain resistance against soiling, spots and spills during the warranty period. ULTIMATE is a scientifically formulated product designed to protect treated fabric and carpeting against most routine soiling conditions.
LIMITED LIFETIME FREE SERVICE WARRANTY
If, after the initial treatment, the Premier Specialty Services’ customer should need the service of our skilled cleaning technicians for spot removal, there will be no charge to the customer. This free service DOES NOT APPLY to accumulated soiling of fabric, leather or carpet and is limited to two calls per any twelve month period. Calls in excess of two per twelve month period will be charged at Ultimate’s then standard rates. While ULTIMATE is designed to resist soiling, it is formulated to breathe so treated materials will continue to look and feel natural. Furnishings treated with ULTIMATE are more cleanable than those left untreated, but dirt and skin oils that accumulate over a period of time are not covered under the ULTIMATE warranty. When soiling is evident, maintenance cleaning is on order and a Premier Specialty Services’ cleaning technician must do the cleaning in order to maintain the warranty. During the term of the warranty, Premier Specialty Services will, at no cost to the client, and at Premier Specialty Services’ sole discretion, completely re-treat any area where such treatment has become ineffective in inhibiting soiling as a result of cleaning, abrasion or usage of any kind.
WARRANTY EXCLUSIONS AND LIMITATIONS
ULTIMATE cannot protect all fabrics and carpeting 100% against all types of contamination. ULTIMATE does not warrant against abrasion, misuse, pets, blood, harsh or corrosive chemicals, substances with alkaline or acidic ingredients, acts which would cause abnormal discoloration or deterioration and normal wear and tear. ULTIMATE does not guarantee that any particular stain will be removable as numerous factors affect stain removing. ULTIMATE is designed to help the material to which it is applied resist soiling and to make cleaning of said material easier.
For non-top coated leathers such as aniline dyed and /or nude leathers like Nubuck, the ULTIMATE application is limited to being a moisture barrier for non viscous materials and is not warranted for stain protection or for increasing resistance to soiling. Because the ULTIMATE leather protection is formulated to breathe, oil based stains, including body oils & lotions and suntan oils may penetrate the leather protection and may not be removable.
Premier Specialty Services’ liability shall be limited to the refund of the initial application price in the event that any warranty is not met.
Premier Specialty Services will make every effort and to perform its work in a workmanlike manner, but does not guarantee removal of stains!CONDITIONS FOR MAINTAINING FREE SERVICE WARRANTY
Customer shall not use the treated area for at least two hours after treatment to allow the product to thoroughly dry. Treated carpet and area rugs must have maintenance cleaning a minimum of once every 12 months by Premier Specialty Services. Treated upholstery must have maintenance cleaning a minimum of once every 24 months by Premier Specialty Services. REPORT ALL WARRANTY CLAIMS WITHIN 5 DAYS OF THE STAINING WHICH LED TO THE WARRANTY CLAIM.
CUSTOMER RESPONSIBILITIES
In addition to meeting the Conditions for Maintaining Free Service Warranty above, Customer shall immediately try to remove or dilute the following staining substances when then come in contact with any treated surface: materials containing alkaline or acidic ingredients, hot beverages (particularly tea and coffee), food dyes (particularly red and yellow) found in mustard, pet foods, powered drink mixes, ceramic cleaners, urine, vomit, indelible inks, wine, furniture and wood stain finishes, X-Coded and Non-Colorfast Fabrics, mishandling, abuse or neglect, mold, mildew or oxidation*, etc…*Oxidation occurs to all fabrics and fibers over time and can affect the dye, producing a color change. Prompt attention by removal and/or dilution, will minimize the potential damage to the surface contaminated. All removal or dilution shall be in accordance with instructions provided by Premier Specialty Services using only approved materials. The use of any other cleaning services or products will void this warranty.
DISPUTE RESOLUTION
All disputes and controversies of every kind and nature between Premier Specialty Services and customer arising out of or in connection with this Limited Lifetime Warranty, shall be submitted to binding arbitration pursuant to the provisions of the Federal Arbitration Act and according to the pertinent rules of the American Arbitration Association (AAA) then in effect and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. The place of arbitration or exclusive venue of case shall be Jefferson County, Colorado. The arbitrator shall award to the prevailing party all of its costs and fees. Either party may request that the award of the arbitrator be accompanied by a reasoned opinion. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of Premier Specialty Services. Both Premier Specialty Services and customer stipulate that the provision hereof shall be a complete defense in any suit, action, class action, class arbitration or proceeding instituted in any federal, state or local court or before any administrative tribunal with respect to any controversy or dispute arising hereunder. All individual provisions of this dispute resolution clause are severable, and any provision of this dispute resolution clause that may be unenforceable or prohibited by law shall be ineffective to the extent of such unenforceability or prohibition without invalidating the remaining provisions of this clause.
-The foregoing warranty is in lieu of all other warranties expressed or implied. Premier Specialty Services neither assumes nor authorizes any representatives or person to assume for us any liability in connection with the sale of our product or associated service.
-This warranty extends only to the original purchaser of ULTIMATE or Premier Specialty Services cleaning services and is not assignable or otherwise transferable.
